Note on the 2020 BGB Reform: Since 23 December 2020, §§656a–d of the German Civil Code (BGB) regulate realtor fees for the sale of residential property (single-family house or owner-occupied apartment) to consumers: if only one party engaged the broker, that party can pass on at most half of the total commission to the other side. In practice this almost always results in a 50/50 split. The rule does not apply to multi-family houses, commercial property or land — other splits remain common there.
